When the Tax Information Exchange Agreement (TIEA) between the Netherlands, on behalf of the Netherlands Antilles and Spain, which has been signed on June 10, 2008 in Madrid, Spain, has entered into force, the Netherlands Antilles have been removed by Spain from its blacklist of tax havens. The above-mentioned tax treaty has been approved by the parliament of the Netherlands on September 23, 2009; this tax treaty will allow the Netherlands Antilles to take advantage of the business which passes through Spain, especially from Latin America. The extensive tax treaty network of Spain in Latin America and the attractive holding regime in Spain (ETVE) in combination with the removal of the Netherlands Antilles from the Spanish blacklist of tax havens and the new profit tax legislation in the Netherlands Antilles has created attractive new tax planning opportunities.
